- This agreement is not in force if the customer's account is delinquent or if the customer is not a current automatic delivery heating oil customer. In addition, the customer must purchase 100% of his/her heating oil requirements (500 gallons per year minimum) from Wood's Heating Service, Inc.
- Wood's Heating Service, Inc. agrees to render service to the customer's oil burning equipment for one year from the month in which customer enrolls (the effective date). Customer agrees to purchase his/her entire fuel oil requirements using automatic delivery for the covered property from Wood's Heating Service, Inc. This service plan will be renewed automatically each year unless terminated in writing by either party 60 days before expiration.
- Prior to placing customer's equipment on the service plan, Wood's Heating Service, Inc. may assess a one-time parts charge to repair the equipment if necessary to bring it up to good operating condition. Labor may also be charged if the repair is major and customer gives prior verbal approval.
- Upon approval, acceptance and payment, this service plan will be effective immediately. Preventive maintenance and combustion service will be performed during the period the plan is in effect at the mutual convenience of the customer and Wood's Heating Service, Inc.
- This service plan is not written on a prorated basis and no refunds will be made if the customer cancels it before its normal expiration date. This service plan is transferrable to another homeowner subject to credit approval but not from one heating system to another. This service plan is void if anyone other than an employee of Wood's Heating Service, Inc. works on the equipment.
- Prices quoted for service plans are for ordinary residential or comparably sized commercial heating systems (firing rate up to 2 gph).
- Wood's Heating Service, Inc.'s obligation to furnish parts shall be subject to their availability through normal supply sources. This service plan does not cover replacement of a complete boiler, furnace, burner, domestic water heater (indirect or oil-fired), humidifier or piping; baffles; oil lines; frozen oil lines; frozen heating systems (regardless of cause); low water cutoff; environmental pollution damage or cleanup of environmental pollution or damage; relief valve; mixing valve; fuel oil tank, oil lines and fittings; or any parts or services not mentioned explicitly in the plan.
- This service plan is designed for and available to customers with a properly maintained account. A finance charge of 1.5% per month (an annual percentage rate of 18%) will be charged on items not paid 30 days from invoice date. If customer account is referred to an attorney for collection, a charge for interest and attorney fees will be included. Said fee will be 33-1/3% plus interest. SERVICE PLAN IS NOT IN FORCE IF CUSTOMER ACCOUNT IS 30 DAYS OVERDUE.
- The service plan includes only repair and replacement of parts specifically listed here in that are defective due to ordinary use or wear and tear based on the judgment of Wood's Heating Service, Inc. Contract does not include service to replace parts damaged by floods, fire, hurricane, explosion, war, acts of God or other causes beyond the control of Wood's Heating Service, Inc. The contract also does not cover labor or parts pertaining to the boiler or furnace sections,circulators, fire chambers, radiator valves, radiators,connected piping, domestic water heating equipment, flow valves, boiler flushing, expansion tanks, zone valves, humidifiers, faucets, automatic water feeders, blower motors, blower bearings or chimneys unless specifically listed in the plan.
- Wood's Heating Service, Inc. shall be released of liability for failure or delay to provide, within reasonable time, the service called for under this plan when failure or delay may result from strike or other labor disturbance; fire, flood, lightning or other acts of God; supply shortages; government regulations; extreme weather conditions; or unavailability of parts. In no case shall Wood's Heating Service, Inc. be responsible beyond the actual repair or replacement cost of the parts or materials covered by this agreement.
- Wood's Heating Service, Inc. shall be released of liability for "run-outs" when the customer is using a supplemental heat source, or when customer's account is past due. (Payment is due within 20 days of fuel delivery or service.)
- Wood's Heating Service, Inc. shall be released of liability for loss of heat or any damage resulting from a freeze-up in an occupied or unoccupied dwelling. It is the customer's responsibility to arrange for a daily house check if customer is away from the premises.
- There shall be no liability for any reason on the part of Wood's Heating Service, Inc. for work done by anyone other than an employee of Wood's Heating Service, Inc. unless such person is authorized in writing by Wood's Heating Service, Inc. to perform such work or furnish parts.
- This plan will be terminated without notice, and without refund, if customer purchases fuel oil from any other source, or refuses automatic delivery.
- This is the entire plan. This plan cancels and supersedes all prior plans on burner service, except installation contracts.
- Wood's Heating Service, Inc. shall be released of liability for any direct or indirect consequential damages in any way arising out of performance or nonperformance of its obligations under this service plan, including but not limited to, injury to or death of person or property damage of any description resulting from defects in or failure of operation of any heating equipment or related items covered under this plan.
- It is the customer's obligation to ensure that heating unit is accessible for service. If it is inaccessible, service will not be performed.
- This service plan DOES NOT COVER OIL TANKS, OIL LINES OR FITTINGS. Wood's Heating Service, Inc. shall be released of liability for any damage whatsoever caused by line or tank leakage or oil leak of any sort or loss of product, whether before or after discovery of a leak, including cost of recovery of lost oil or removal of contaminated earth or other property. The customer is responsible for notifying appropriate government agencies.
- During the life of this agreement, Wood's Heating Service, Inc. will provide dependable, prompt,emergency service 24 hours a day, 7 days a week, 365 days a year. The following circumstances constitute emergency service: no heat, no hot water, smoke, serious fuel leaks or dangerous situations.
- Loyalty Credits may not be combined with any other offers.
- If payment is not received within 25 days of billing date,the contract is subject to cancellation and all work performed will be billed at the current hourly rate.
